パレスチナの171団体が署名した「ボイコットと資本の引き揚げ、制裁措置に向けた呼びかけ文」です。

何よりもまず、パレスチナ人たちの側が非常にピンチな状況にあるなかで、かなり多数のパレスチナ人たちの運動団体が、一致点を見出す形で、今後に向けた一定の方向性を提出した（というか、パレスチナ人たち自身の運動の側でのイニシアチブの一つ）ということには意味があるのではないかと考えます。

また、南アフリカの反アパルトヘイトの闘いへのパレスチナ人たちの側からの注目、占領地の問題と同じレベルでイスラエル国内のパレスチナ人たちの状況に言及している点、なども注目すべき点かな、と思います。

国際法および人権という普遍原理の遵守までイスラエルに対するボイコットと資本の引き揚げ、制裁措置を行うよう求めるパレスチナの市民社会からの呼びかけ

占領下にあるパレスチナ人たちの領土にイスラエルが建設した壁は違法であると判断した、国際司法裁判所（ICJ）の歴史的な勧告的意見が出されてから１年が経った。しかしイスラエルは、このICJの判断を完全に無視して、植民地支配のための壁の建設を続けている。パレスチナ人たちの西岸地区（東エルサレムを含む）とガザ回廊、そしてシリア人たちのゴラン高原がイスラエルによって占領されてから38年間、イスラエルはユダヤ人入植地を拡張し続けている。イスラエルは、軍事占領した東エルサレムとゴラン高原を一方的に併合し、今や、この壁という手段によって西岸地区の広大な土地を事実上併合しつつある。さらにイスラエルは、ガザ回廊からの再展開という計画の裏で、西岸地区での入植地の建設と拡張に向けた準備を進めている。イスラエル国家が建設された土地の大部分は、パレスチナ人の土地所有者たちが民族浄化された場所であった。それから57年が過ぎて、パレスチナ人の大多数は今も難民であり、その難民のほとんどは国籍や市民権を持っていない。その上、国内のアラブ・パレスチナ人市民に対する人種差別主義的な体制は固定化され、今もそのままである。

イスラエルによる一貫した国際法違反ゆえに、

1948年以降の数百もの国連決議が、イスラエルの植民地主義的かつ差別的な諸政策を違法なものとして非難し、即刻かつ適切で実効的な救済策を求めてきたことを踏まえて、

また今日に至るまで、あらゆる形態の国際的な介入と平和構築は、人道的な法律に従い、基本的人権を尊重し、そしてパレスチナの占領とその人々に対する抑圧を終わらせるようにとイスラエルを説得する、あるいは強いることができないままであったことを踏まえて、

国際社会における良心的な人々が、ボイコットや資本の引き揚げ、制裁措置という多様な手段を用いて南アフリカのアパルトヘイト体制を撤廃させようとし、その闘争に具体的に示されているように、不公正と闘うという道義的な責任を歴史的に担い続けてきた事実ゆえに、

アパルトヘイト体制に対する南アフリカの人々の闘争に触発されて、さらには国際連帯と道義的決意、不公正と抑圧に抗するレジスタンスの精神を持って、

我々、パレスチナの市民社会の代表たちは、世界中の良心的な人々と市民社会の諸組織に向けて、アパルトヘイト期の南アフリカに適用されたのと同様の、広範なボイコットと資本の引き揚げの実行をイスラエルに対して行うようにと呼びかける。我々は、皆さんのそれぞれの国に対して、イスラエルに対する輸出入の禁止と制裁措置を実施すべきとの圧力をかけるよう、皆さんに要請する。さらに我々は、正義と真の平和のために、この呼びかけを支援してくれるよう、良心的なイスラエル人たちに求める。

これらの非暴力的な懲罰措置は、イスラエルが、パレスチナの人々の自決権という奪われることのできない権利を承認するという責務を果たすまで、また以下に掲げる国際法の諸勧告に完全に従うまで、継続されることとする。

つまり；

  1. アラブの人々の土地に対する占領と植民地化の一切を終わらせること、そして壁を撤去すること、
  2. イスラエル内のアラブ=パレスチナ人市民の基本的な諸権利を、完全に平等なものとして承認すること、
  3. 国連決議194号に明記されている通り、パレスチナ人難民たちが自らの家に帰還し、財産を取り戻すという彼らの権利を尊重し、保護し、そして支援すること、である。

【解説】

イスラエルが建設した壁

アパルトヘイト・ウォール。隔離壁・分離壁などとも呼ばれる、イスラエルが「テロリストのイスラエルへの侵入を防ぐため」と称してヨルダン川西岸地区に建設中の壁。しかしながらその壁は、イスラエルとパレスチナの境界に建設されているのはでなく、90%以上がパレスチナの中に侵入してパレスチナ人の土地を奪いながら建設されている。肥沃な土地を奪う、水資源を奪う、パレスチナの町と町を分断する、町を分断することで文化・教育・経済などパレスチナ人のあらゆる生活を破壊する、町と町を分断するどころか町や村の中に壁を作り一方をイスラエル側にしてしまうことでそこに暮らす住民を追放する、住居と農地の間を壁で遮断することで農業を破壊する、パレスチナ人の土地を囲い込むことでパレスチナ人の人口が増えることを抑制する、単に領土を拡大するなどなど、様々な場所で様々な目的を持つ壁が建設されている。壁建設の中止と撤去を求める国連決議（2003年10月21日）や国際司法裁判所の勧告（2004年7月9日）が出された後も、イスラエルはアメリカの保護のもと、それらをあっさりと無視し壁建設を続けている。

国際司法裁判所（ICJ）

法律的な判断を下す国連の主要機関。裁判所に訴えを提起できるのは、個人ではなく、国家だけ。ある国がある事件について国際司法裁判所の管轄権を認める場合、その国は、裁判所の判決に従うことを約束しなければならない。さらに国連のその他の機関も、国際司法裁判所に勧告的意見を求めることができる。（国連連合広報センター、ホームページ を参照）

イスラエルが建設した壁は違法であると判断した、国際司法裁判所（ICJ）の歴史的な勧告的意見

2004年7月9日、国際司法裁判所（ICJ）は、アパルトヘイト・ウォール建設について概ね次のような勧告を出した。壁の建設は、ジュネーブ第4条約などの国際人道法、国際人権規約、および関連する国連安保理決議に違反する。壁は、グリーンライン（1949年イスラエル・ヨルダン休戦協定で指示された境界線）と壁との間の区域に、イスラエル人入植地の大多数が含まれるよう湾曲した経路で建設されており、事実上の領土併合である。これは武力による領土の取得を禁じる原則に反しており、パレスチナ人の領土的主権と自決権を侵害している。イスラエルは、現在進行中の壁の建設作業を即時中止しなければならない。また、イスラエルは壁建設のために接収した不動産を返還し、それらの原状回復が不可能な場合は当該被害者に賠償する義務を有する。（詳しくは、JVC：私たちは「壁」建設の即時中止と原状回復を求めます を参照）

国連総会は、パレスチナの状況を再検討した結果、…

11.以下のことを決定する。自らの郷土へ帰ることを望む難民に関しては、できるだけ速やかに帰還させ、隣人と平和に暮らすことを可能にするべきである。一方、自らの郷土には戻らないという決意を固めた難民については、彼らの財産に関する補償として、賠償金が支払わなければならない。また、失われた財産もしくは損害を被った財産に対しても、賠償金が支払われるべきである。この場合、国際法上の原則に従って、あるいは公正であるために、このような損失や損害は、責任を負うべき政府や当局者たちによって補償されなければならない。（創元社：知の再発見双書『パレスチナ』P169より）
